Terms of Service

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services provided by Maple Bloom Garden Co. (“Maple Bloom Garden Co.,” “we,” “us,” or “our”), including any related communications, estimates, proposals, invoices, and service arrangements. By requesting, scheduling, accepting, or paying for any services from Maple Bloom Garden Co., you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use or continue to use our services. These Terms apply to all customers, property owners, tenants, occupants, and any other person who authorizes or benefits from our services.
2. Scope of Services
Maple Bloom Garden Co. provides residential and commercial garden and landscape maintenance services in Canada, which may include, without limitation:
- Garden design and planting
- Lawn and turf care
- Seasonal cleanups
- Hedge trimming and pruning
- Mulching and soil improvement
- Irrigation system maintenance
- Weed control and bed maintenance
Service descriptions, timelines, and deliverables may be set out in a written estimate, proposal, work order, service agreement, or invoice. Any such document forms part of the agreement between you and Maple Bloom Garden Co. In the event of a conflict, these Terms will govern unless the other document expressly states that it overrides these Terms and is signed or otherwise accepted by Maple Bloom Garden Co.
We may refuse, suspend, or discontinue services at our discretion where property conditions, weather, safety concerns, legal restrictions, access issues, or non-payment make performance impractical or unsafe.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and current information when requesting services;
- Ensure that we have safe, timely, and unobstructed access to the property and all areas where services are to be performed;
- Disclose known hazards, including underground utilities, irrigation lines, pets, stinging insects, contaminated soil, unstable structures, slippery surfaces, or other site-specific risks;
- Obtain all necessary permissions, approvals, permits, or consents required for the requested services, including landlord, condominium, municipal, or homeowners’ association approvals where applicable;
- Remove or secure valuables, fragile items, decorations, personal property, and obstacles from work areas before service begins;
- Keep children, pets, and unauthorized persons away from active work areas;
- Comply with all applicable laws, bylaws, and property rules relating to the services;
- Promptly review completed work and notify us of any concerns within a reasonable time after service completion.
You acknowledge that certain gardening and landscaping activities may involve inherent risks, including plant stress, weather-related effects, soil disturbance, and temporary disruption to the appearance of the property. You are responsible for informing us of any special instructions, allergies, sensitivities, or restrictions relevant to the services.
4. Payment Terms and Conditions
Unless otherwise agreed in writing, all fees are due in accordance with the invoice issued by Maple Bloom Garden Co. Payment terms may include deposits, progress payments, milestone payments, or payment upon completion depending on the nature of the work.
- All prices are stated in Canadian dollars unless otherwise indicated.
- Applicable taxes, including GST/HST and any other required taxes, will be added where required by law.
- Estimates are based on the information available at the time and may change if site conditions, scope, materials, access, or customer instructions differ from what was originally represented.
- Additional work requested by you, or reasonably required due to unforeseen conditions, may be billed separately.
- Late or overdue amounts may be subject to interest at the maximum rate permitted by applicable law, or if no rate is specified, a reasonable administrative charge.
- We may suspend services, withhold future bookings, or decline further work if invoices remain unpaid.
You are responsible for all collection costs, including reasonable legal fees and disbursements, incurred by Maple Bloom Garden Co. in recovering overdue amounts, to the extent permitted by law.
5. Cancellation and Refund Policy
Cancellations or rescheduling requests should be made as early as possible by contacting Maple Bloom Garden Co. directly. Because service appointments reserve labour, equipment, and scheduling capacity, cancellation fees may apply.
- If you cancel a scheduled service with less than 24 hours’ notice, you may be charged a cancellation fee or minimum service charge.
- If our team arrives on-site and cannot perform the service due to lack of access, unsafe conditions, or customer unavailability, a trip charge or minimum service fee may apply.
- Deposits, if required, may be non-refundable to the extent they cover scheduling, materials, or preparatory work already incurred.
- Refunds, if any, are issued only at the discretion of Maple Bloom Garden Co. and only for services not yet performed, except where otherwise required by law.
Weather-sensitive services may be rescheduled when conditions make performance unsafe or impractical. We will use reasonable efforts to notify you of such changes. No refund will be due for rescheduling caused by weather, force majeure, or conditions beyond our reasonable control.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Bloom Garden Co. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of enjoyment, loss of use, loss of profits, or loss of business opportunity, arising out of or related to the services or these Terms.
Without limiting the foregoing, Maple Bloom Garden Co. is not responsible for:
- Pre-existing property conditions, hidden defects, or structural issues;
- Damage caused by undisclosed hazards, defective irrigation systems, buried utilities, pest infestations, or unstable ground;
- Plant failure, turf stress, or landscape decline caused by weather, drought, disease, pests, improper care by others, or conditions beyond our control;
- Damage resulting from customer instructions, requested deviations from standard practice, or failure to follow our recommendations;
- Delays or non-performance caused by events beyond our reasonable control.
Where liability cannot be excluded under applicable law, Maple Bloom Garden Co.’s total aggregate liability for any claim arising from or relating to the services will be limited to the amount paid by you for the specific service giving rise to the claim, or the minimum amount permitted by law, whichever is greater.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or other non-excludable obligations under Canadian law.
7. Intellectual Property Rights
All content, materials, designs, templates, estimates, proposals, photographs, drawings, plans, written descriptions, and other works created or provided by Maple Bloom Garden Co. remain our property or the property of our licensors, unless otherwise agreed in writing.
Subject to full payment of all amounts due, you are granted a limited, non-exclusive, non-transferable licence to use any deliverables created specifically for you solely for the purpose of enjoying and maintaining the services provided at your property. You may not reproduce, distribute, sell, modify, or use our materials for commercial purposes without our prior written consent.
We may, unless you object in writing, take photographs or videos of completed work for recordkeeping, quality assurance, training, and marketing purposes, provided that any personal information is handled in accordance with applicable privacy laws.
8. Data Protection and Privacy
Maple Bloom Garden Co. collects, uses, and discloses personal information only as reasonably necessary to provide services, manage customer relationships, process payments, communicate with you, comply with legal obligations, and improve our operations. We handle personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
Personal information may include your name, address, contact details, billing information, service history, and property-related instructions. We may share personal information with trusted service providers, payment processors, contractors, or advisors who assist us in operating our business, subject to appropriate confidentiality and security safeguards.
You consent to our collection, use, and disclosure of personal information for the purposes described in these Terms and in any applicable privacy notice we provide. You may contact us to request access to or correction of your personal information, subject to legal and contractual limitations.
We take reasonable administrative, technical, and physical measures to protect personal information, but no method of transmission or storage is completely secure. To the extent permitted by law, Maple Bloom Garden Co. is not liable for unauthorized access or disclosure resulting from circumstances beyond our reasonable control.
9. Force Majeure
Maple Bloom Garden Co. will not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to severe weather, floods, storms, fire, power outages, labour disputes, supply shortages, transportation disruptions, acts of government, public health emergencies, war, terrorism, civil unrest, or utility failures.
In the event of force majeure, we may suspend, reschedule, or modify services as reasonably necessary. We will use commercially reasonable efforts to resume performance as soon as practicable.
10. Changes to Terms
Maple Bloom Garden Co. may update or revise these Terms from time to time to reflect changes in our business practices, legal requirements, or service offerings. The updated Terms will be effective upon posting or upon notice to you, as applicable.
Your continued use of our services after any changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of our services.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your relationship with Maple Bloom Garden Co. shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the services, subject to any mandatory consumer protection rights or other non-waivable rights under applicable law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and enforced to the maximum extent permitted by law in a manner that best reflects the original intent of the parties.
